What Is the PACT Act?

The federal Prevent All Cigarette Trafficking Act (PACT Act), expanded in 2021 to include electronic nicotine delivery systems (ENDS) and certain vapor products, regulates the interstate sale and shipment of tobacco and vapor products. The expanded PACT Act may apply to products sold by Area51 Holistic Wellness.

Our Compliance Commitments

Area51 Holistic Wellness is committed to full compliance with all applicable federal, state, and local laws regulating the sale of smoking accessories and vapor products. This includes:

  • Age verification at point of sale and at delivery (21+, with government-issued ID)
  • Adult signature required on all deliveries via the U.S. Postal Service or private carriers
  • Registration with the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) where required
  • State-level registration with applicable tobacco/excise tax authorities
  • Monthly reporting to applicable state authorities listing all shipments where required
  • Excise tax collection and remittance to applicable state authorities
  • Shipping restrictions — we do not ship to states where applicable products are prohibited

What This Means for Customers

Your information may be reported to your state tax authority. Federal law may require us to provide your name, address, and the products you purchased to the tax authority in your state. This is a legal requirement, not a choice.

Adult signature is mandatory. No package will be left without a 21+ adult signing for it.

Some states are not eligible for shipment. If your state prohibits or heavily restricts shipping of products in your cart, you will not be able to complete checkout.

Customer Verification

By placing an order, you certify that:

  • You are at least 21 years old
  • You are purchasing for your own personal, legal use
  • You are not purchasing on behalf of a minor or for resale
  • The information you provide (name, address, age) is true and accurate
  • You consent to age verification at delivery
  • You understand your information may be reported to applicable state authorities as required by federal law
